The European Union has established harmonized rules on the nominal quantities of prepacked products through Directive 2007/45/EC of the European Parliament and of the Council of 5 September 2007. This directive lays down standardized packaging sizes for several product categories, including wines, aromatized wines, and spirit drinks, in order to ensure fair competition, consumer protection, and market transparency across the EU.
The EU Standard for Spirit Drinks
According to the directive, spirit drinks may only be marketed within the European Union in a limited range of nominal quantities, defined as:
100 ml – 200 ml – 350 ml – 500 ml – 700 ml – 1,000 ml – 1,500 ml – 1,750 ml – 2,000 ml
This list makes it clear that the standard bottle size for spirits in Europe is 700 ml, not 750 ml. While 750 ml is a common format in other regions, particularly North America. But it is not part of the EU’s permitted range for spirit drinks.
Common Compliance Issue: 750 ml Bottles in the EU
Some non-European producers, as well as distributors importing goods into the EU, continue to sell 750 ml bottles of spirits. While this format is accepted in markets such as the United States and Canada, it does not comply with EU packaging rules.
Recently, Spanish customs authorities flagged this issue with certain consignments of 750 ml spirit bottles entering the EU. Since the directive applies at the European level, this is not limited to Spain only: all EU Member States are required to enforce the same standard.
Responsibilities of producers and sellers
The responsibility for compliance lies with the producers, importers, and sellers of spirit drinks. Businesses placing products on the EU market must ensure that their packaging sizes align with the EU directive. Selling non-standard formats (such as 750 ml) can lead to customs interventions, fines, or even the blocking of goods at the border.
What should companies do to stay in compliance?
- Communicate Clearly – Make it clear to all partners, clients, and distributors that the standard EU format for spirits is 700 ml, not 750 ml.
- Ensure Compliance – Producers and importers should adjust their packaging strategy for the EU market to conform to Directive 2007/45/EC.
